Article 3.3

(Remedies for fraudulent conduct)

(1)  If a reinsured makes a fraudulent claim under the contract of reinsurance, the reinsurer

(a)  is not liable to pay the fraudulent claim;

(b)  may recover any sums paid in respect of the fraudulent claim;

(c)  in addition, may claim damages;

(d)  may terminate the contract according to Article 3.1(2).

(2)  If the reinsurer seeks to gain an advantage to the detriment of the reinsured by fraudulent means, the remedies provided for in paragraph (1) shall apply mutatis mutandis.
